NisonCo Inc. (“NisonCo,” “we,” “us,” or “our”) is a public relations, search engine optimization, and AI consulting agency headquartered in East Brunswick, New Jersey. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit nisonco.com (the “Site”), interact with our marketing, attend our events, contact us, or become our client.

This Policy is written to comply with the New Jersey Data Privacy Act (“NJDPA”), the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”), the General Data Protection Regulation (“GDPR”) and UK GDPR for visitors from the European Economic Area and United Kingdom, and other applicable U.S. state privacy laws including those of Colorado, Connecticut, Delaware, Indiana, Iowa, Maryland, Minnesota, Montana, New Hampshire, Oregon, Tennessee, Texas, Utah, and Virginia.

1. Information We Collect

We collect personal information in the following categories. What we actually collect depends on how you interact with us.

a. Information you provide directly

When you submit our contact form (at nisonco.com/contact/), our newsletter signup, or any other form on the Site, we collect identifiers (name, email, phone if provided, mailing address if provided, company name, job title), commercial information (services inquired about, project history, billing information for clients), communications you send us, newsletter preferences, and event registration details if you attend NisonCo events.

Our contact form and newsletter signup are hosted by ActiveCampaign, our customer relationship management and email marketing platform. Information submitted through these forms is transmitted to and stored in ActiveCampaign in addition to our internal systems.

b. Information collected automatically when you visit the Site

Device and browser information (IP address, browser type, operating system, device type), usage information (pages visited, time on page, links clicked, referring URL, scroll depth), cookies and similar technologies (see our Cookie Policy), and approximate location derived from IP address.

c. Information from third parties

Lead enrichment data from B2B data providers, publicly available information about you or your company, and marketing platform engagement data from ActiveCampaign (email open rates, click rates, engagement metrics).

d. Sensitive personal information

We do not knowingly collect sensitive personal information (Social Security numbers, government IDs, precise geolocation, racial or ethnic origin, religious beliefs, health information, sexual orientation, biometric data). If you voluntarily provide sensitive information in correspondence (for example, dietary restrictions at an event), we use it only for the specific purpose provided.

2. How We Use Personal Information

We use personal information to respond to inquiries and provide requested services; deliver and improve our public relations, SEO, and AI consulting services to clients; send newsletters and marketing emails (with consent or as permitted by law); schedule and prepare for sales calls; process invoices and payments; analyze Site usage; detect and prevent fraud; comply with legal obligations; enforce our Terms; and pursue legitimate business interests including business development and account management.

3. Legal Bases for Processing (EU/UK Visitors)

If you are in the EEA or UK, we process your personal information under one of the following lawful bases: Consent (for marketing emails, certain cookies, and sensitive information); Contract (to deliver services or take pre-contractual steps); Legitimate interests (for business development, security, analytics, and commercial relationships); Legal obligation (to meet legal, regulatory, and tax requirements).

4. AI and Automated Processing

NisonCo uses artificial intelligence systems extensively in our business operations, including AI-assisted drafting of emails, content, outreach, and client deliverables; AI-powered lead scoring and qualification (this does not produce legal or similarly significant effects on you); AI-assisted research about prospects and clients; AI-driven content recommendations and personalization; and internal AI tools for project management, scheduling, call transcription, and analysis.

Our commitment on AI model training

NisonCo configures our use of third-party AI services to prevent your information from being used to train those companies’ AI models. Specifically: we access AI services such as OpenAI’s API and Anthropic’s API through arrangements that do not use input data for model training; we do not knowingly send customer or visitor personal information to consumer AI products with default training-on settings, and we configure team accounts to opt out of training data use where consumer interfaces are used; we train our team to follow these practices and never submit confidential customer information to AI tools that train on user inputs.

Where required by law, we will obtain your consent for specific AI processing or honor your right to opt out of solely automated decisions that have legal or similarly significant effects on you. None of our current AI uses produce such effects without human review.

5. Third Parties With Whom We Share Information

We do not sell personal information for money. We share information with the following categories of recipients where necessary:

a. Service providers and processors

Marketing automation and CRM: ActiveCampaign (newsletter delivery, contact form submissions, lead management, email marketing automation). Scheduling: Calendly. Analytics: Google Analytics, Google Tag Manager, Google Search Console. Advertising platforms: We currently do not run active advertising campaigns. Hosting and security: Our website hosting provider, content delivery network, and Wordfence (security monitoring). Communications and transcription: Email providers; Fireflies.ai for call recording and transcription. Payments and accounting: Intuit QuickBooks and payment processors. Productivity: ClickUp, Google Workspace, Slack. AI providers: OpenAI, Anthropic, and similar providers (under the terms described in Section 4). Document management: Google Drive, NisonDocs. Professional advisors: Our attorneys, accountants, and similar professionals.

We require these service providers to handle your personal information consistent with this Policy and with applicable law.

b. Sharing for cross-context behavioral advertising

We currently do not run active advertising campaigns. If we resume advertising in the future, our use of advertising cookies could qualify as “sharing” under the CCPA/CPRA. We will update this Policy and provide opt-out mechanisms before any such advertising resumes.

c. Business transfers

If NisonCo undergoes a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction. We will notify you and provide choices to the extent required by law.

d. Legal disclosures

We may disclose personal information when required by law, in response to lawful requests by public authorities, or to protect our rights, your safety, or the rights and safety of others.

6. Data Retention

We keep personal information only as long as we need it for the purposes described in this Policy, or as required by law. Maximum retention periods:

  • Contact form and inquiry submissions: up to 7 years from the date of last interaction
  • Newsletter subscribers: until you unsubscribe, plus up to 90 days for suppression list compliance
  • Client records: for the duration of our engagement plus 7 years (tax and contractual purposes)
  • Website analytics: aggregated data indefinitely; individual-level data up to 26 months by default in Google Analytics
  • Marketing communications data within ActiveCampaign: up to 3 years from your last engagement
  • Job applications: up to 2 years from submission
  • Server logs and security data: up to 90 days, longer if needed for active security investigations

When retention periods expire, we delete or de-identify the information. You may request earlier deletion at any time by emailing evan@nisonco.com.

7. Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies. Some are strictly necessary; others enable analytics and personalization. See our Cookie Policy for the complete list.

We are in the process of implementing a cookie consent banner. Once deployed, the banner will allow you to accept or reject non-essential cookies. In the meantime, you can manage cookies through your browser settings.

We are implementing support for the Global Privacy Control (“GPC”) browser signal. Once deployed, when GPC is enabled, we will treat it as a request to opt out of any “sale” or “sharing” of your personal information for cross-context behavioral advertising.

8. Marketing Communications

Email: When you provide your email address, we may send marketing emails about our services, content, and events. Every marketing email includes an unsubscribe link. You can also opt out by emailing evan@nisonco.com.

SMS/text messages: NisonCo does not send marketing SMS or text messages. We will not send marketing text messages even if you provide your phone number. If our practices change in the future, we will update this Policy and obtain your express written consent (as required under TCPA) before sending any marketing text messages.

Telephone: We will not call you for marketing purposes unless you have an existing business relationship with us or have provided prior express written consent. We honor the National Do Not Call Registry.

9. Your Privacy Rights

Your privacy rights depend on where you live. Below are the rights you have under various laws and how to exercise them.

a. All visitors

Regardless of where you live, you can request a copy of your information, ask us to correct or delete it, unsubscribe from marketing, and object to certain uses. Email evan@nisonco.com with your request.

b. California (CCPA/CPRA) residents

You have the right to know what personal information we have collected in the prior 12 months; to request deletion; to correct inaccurate information; to opt out of “sale” or “sharing”; to limit use of sensitive personal information; and to non-discrimination for exercising your rights. To exercise California rights, email evan@nisonco.com. We may need to verify your identity. You may designate an authorized agent. We respond to verified requests within 45 days (extendable by 45 days with notice).

Categories of personal information collected, sold, or shared in the prior 12 months: We collect identifiers, commercial information, internet/network activity, approximate geolocation, professional/employment information, and inferences. We do not collect sensitive personal information. We do not “sell” or “share” personal information.

c. New Jersey (NJDPA) residents

The New Jersey Data Privacy Act took effect January 15, 2025. As a NJ resident, you have the right to confirm processing, access your data, correct it, delete it, obtain a portable copy, opt out of targeted advertising and “sale,” and opt out of profiling that has legal or similarly significant effects. We respond within 45 days (extendable by 45 days) and will respond to appeals within 60 days. We are implementing support for the Global Privacy Control browser signal as a universal opt-out mechanism. Email evan@nisonco.com to exercise these rights.

d. Other state privacy laws

If you reside in Colorado, Connecticut, Delaware, Indiana, Iowa, Maryland, Minnesota, Montana, New Hampshire, Oregon, Tennessee, Texas, Utah, or Virginia, you generally have similar rights to access, correct, delete, and obtain a portable copy of your personal data, and to opt out of targeted advertising, “sale,” and certain profiling. Email evan@nisonco.com and identify your state of residence.

e. European Economic Area and United Kingdom residents (GDPR / UK GDPR)

You have the right to access, rectify, erase, restrict, and port your personal data; to object to processing based on legitimate interests; to withdraw consent at any time; and to not be subject to fully automated decisions with legal or similarly significant effects. You may lodge a complaint with your local supervisory authority. Email evan@nisonco.com. We respond within 30 days (extendable to 60 days with notice).

10. How to Exercise Your Rights

Email evan@nisonco.com with your full name, the email addresses you’ve used with NisonCo, your state or country of residence, the specific right you wish to exercise, and sufficient information for us to verify your identity. We respond to verified requests within the legally required timeframe and will not retaliate or discriminate against you for exercising your privacy rights.

11. “Do Not Sell or Share My Personal Information”

We do not sell personal information for money. We currently do not run active advertising campaigns that would involve “sharing” personal information for cross-context behavioral advertising. If our practices change and we resume advertising activities that qualify as “sharing,” we will update this Policy, deploy a “Do Not Sell or Share My Personal Information” link, honor the Global Privacy Control browser signal as an opt-out, and honor opt-out requests submitted to evan@nisonco.com.

12. Children’s Privacy

Our Site and services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us at evan@nisonco.com so we can delete it. For visitors aged 13–16 in jurisdictions with heightened protections, we do not knowingly process their personal information for targeted advertising or profiling without parental consent where required.

13. International Data Transfers

NisonCo is based in the United States. If you are outside the U.S., your personal information will be transferred to and processed in the U.S., which may have data protection laws different from your jurisdiction. For transfers from the EEA or UK to the U.S., where required, we rely on appropriate safeguards such as Standard Contractual Clauses.

14. Data Security

We implement reasonable technical, administrative, and physical safeguards to protect personal information from unauthorized access, disclosure, alteration, or destruction. These include access controls, encryption in transit, security monitoring (via Wordfence and other tools), and employee training. No system is completely secure, however, and we cannot guarantee absolute security. If we become aware of a data breach affecting your personal information, we will notify you in accordance with applicable law.

15. Third-Party Links

Our Site may contain links to third-party websites and tools. We are not responsible for the privacy practices of those third parties. We encourage you to read their privacy policies before sharing any personal information with them.

16. Changes to This Privacy Policy

We will update this Privacy Policy as our practices change and as required by law. We will update the “Last Updated” date at the top and, where required, provide more prominent notice for material changes. This Policy was updated on June 15, 2026 to reflect the New Jersey Data Privacy Act, updated CCPA/CPRA requirements, the addition of AI-assisted processing throughout our work, the contact form and newsletter signup widgets on our Site, and clarification of third-party service providers we work with.
